Terms of Service

TERMS OF SERVICE

These Terms of Service govern your access to and use of Minute Momentum’s website, coaching services, digital resources, coaching platform, and related services. By purchasing, enrolling in, accessing, or using Minute Momentum services, you agree to these Terms.

COACHING SERVICES

Minute Momentum provides fitness, nutrition, habit, accountability, education, and lifestyle coaching. Specific services and features may vary depending on the coaching program or service selected.

Minute Momentum provides coaching and educational services and does not provide medical diagnosis, medical treatment, physical therapy, or other licensed healthcare services.

HEALTH, MEDICAL CLEARANCE & CLIENT RESPONSIBILITY

Before beginning or materially changing an exercise, nutrition, or lifestyle program, clients are responsible for determining whether consultation with a physician or other qualified healthcare professional is appropriate.

Clients with known medical conditions, injuries, concerning symptoms, pregnancy, medications that may affect exercise or nutrition, or other health concerns should obtain appropriate professional guidance or medical clearance before participating.

By participating in Minute Momentum coaching, you represent that you are physically capable of participating in the activities you choose to undertake and that you have obtained any medical clearance reasonably necessary for your individual circumstances.

You agree to provide accurate information relevant to your coaching and to promptly communicate injuries, physical limitations, concerning symptoms, medical restrictions, or material changes that may affect your ability to participate safely.

Minute Momentum coaching, including personalized training and nutrition recommendations, is educational and coaching-based and is not a substitute for care from a physician, registered dietitian, physical therapist, or other appropriately licensed healthcare professional when such care is necessary.

EXERCISE & NUTRITION PARTICIPATION

You voluntarily choose whether to perform or follow exercise, nutrition, habit, or lifestyle recommendations provided through Minute Momentum.

You are responsible for exercising reasonable judgment, using equipment appropriately, maintaining a safe exercise environment, using appropriate technique, following applicable safety instructions, and selecting activities appropriate for your abilities and circumstances.

You should stop exercising and seek appropriate medical attention if you experience chest pain or discomfort, severe or unusual shortness of breath, fainting, severe dizziness, significant pain, or other concerning symptoms.

Nutrition coaching and recommendations are intended to support general fitness, performance, body-composition, habit, and lifestyle goals. They are not intended to diagnose, treat, cure, or prevent disease or to provide medical nutrition therapy.

Clients remain responsible for their food choices, dietary decisions, and communicating known food allergies, intolerances, medical dietary restrictions, or other relevant concerns.

ASSUMPTION OF RISK

You understand that physical exercise and changes in physical activity, nutrition, and lifestyle involve inherent risks, including the possibility of injury or other adverse effects.

By voluntarily participating in Minute Momentum coaching and choosing to perform recommended activities, you acknowledge and accept the ordinary risks associated with such participation.

CLIENT PARTICIPATION

Coaching is a collaborative process. Clients are responsible for their own decisions, actions, participation, communication, and implementation of coaching recommendations.

Minute Momentum may modify recommendations based on information provided by the client, progress, feedback, schedule, available equipment, travel, lifestyle, and other relevant circumstances.

RESULTS

Minute Momentum provides personalized coaching, structure, education, accountability, and tools designed to support client progress.

Individual results vary based on numerous factors, including consistency, adherence, health status, lifestyle, individual physiology, starting point, and circumstances outside Minute Momentum’s control.

Minute Momentum does not guarantee any specific result, amount of weight loss, muscle gain, body-composition change, performance improvement, or other outcome.

PAYMENTS & PROGRAM COMMITMENTS

Pricing, program length, payment schedule, and included services are presented at enrollment or otherwise agreed upon with the client.

Selecting an installment or payment plan does not convert a fixed-term coaching program into a month-to-month service. A payment plan simply divides the total program fee into scheduled payments.

Clients remain responsible for payments associated with the coaching term selected at enrollment, even if they choose to stop participating before the end of that term, except where otherwise required by applicable law.

CANCELLATIONS, REFUNDS & RENEWALS

Refunds, cancellations, payment-plan obligations, and renewals are governed by Minute Momentum’s Refund & Cancellation Policy, which is incorporated into these Terms.

Where applicable, clients may cancel a future renewal in accordance with that policy. Canceling a future renewal does not eliminate payment obligations associated with an existing fixed-term coaching commitment.

COACHING PLATFORM & THIRD-PARTY SERVICES

Minute Momentum may deliver portions of its services through third-party software, mobile applications, payment processors, communication services, wearable integrations, video services, analytics tools, or other technology providers.

Availability and functionality of third-party services may change and may be subject to the provider’s own terms and privacy practices.

Minute Momentum is not responsible for outages, interruptions, changes, or failures caused by third-party platforms outside its reasonable control.

WEARABLES & CONNECTED SERVICES

Clients may have the option to connect supported wearable devices, health or fitness services, or other integrations to the Minute Momentum coaching platform.

Use of these integrations is voluntary. Data provided through connected services may be used to help personalize coaching, monitor progress, and provide feedback.

Clients are responsible for the accuracy and operation of their devices and third-party services.

COMMUNICATIONS

By providing contact information in connection with Minute Momentum services, you agree that Minute Momentum may communicate with you regarding your coaching, account, appointments, payments, program information, and other service-related matters through available communication methods.

INTELLECTUAL PROPERTY

Minute Momentum’s branding, logos, coaching materials, programs, training resources, workouts, written materials, graphics, videos, educational resources, methods, and other proprietary content are owned by or licensed to Minute Momentum unless otherwise stated.

Materials provided through Minute Momentum are intended for the client’s personal, non-commercial use.

Users may not reproduce, distribute, sell, republish, sublicense, commercially exploit, or provide proprietary Minute Momentum materials or account access to others without authorization.

ACCOUNT & PLATFORM ACCESS

Access to Minute Momentum’s coaching platform or digital resources may be limited to active clients or users with authorized access.

Clients are responsible for maintaining the confidentiality of their account credentials and should not provide their account access to unauthorized individuals.

ACCEPTABLE USE

Users may not misuse the Minute Momentum website or coaching platform, attempt unauthorized access, interfere with its operation, distribute malicious software, impersonate another person, unlawfully copy content, or use Minute Momentum services for unlawful purposes.

AVAILABILITY & MODIFICATIONS

Minute Momentum may reasonably update, improve, replace, or modify features, resources, technology, coaching processes, or methods used to deliver its services.

Temporary interruptions may occur because of maintenance, software updates, third-party services, internet availability, or circumstances outside Minute Momentum’s reasonable control.

PRIVACY

Collection and use of personal information associated with the website and Minute Momentum services are described in the Minute Momentum Privacy Policy.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Minute Momentum will not be liable for indirect, incidental, special, consequential, or similar damages arising from or related to use of the website, coaching platform, digital resources, or services.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

TERMINATION OR SUSPENSION

Minute Momentum may suspend or terminate access to services for material violations of these Terms, misuse of services, nonpayment, abusive or threatening conduct, unlawful activity, unauthorized sharing of proprietary materials or account access, or conduct that materially interferes with Minute Momentum’s ability to provide its services, subject to applicable law and existing contractual obligations.

Termination or suspension does not automatically eliminate outstanding payment obligations associated with an existing fixed-term coaching commitment, except where otherwise required by applicable law.

GOVERNING LAW

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

CHANGES TO THESE TERMS

Minute Momentum may update these Terms periodically to reflect changes in its services, business practices, technology, or legal requirements.

The current version will be posted on this page with its effective date. Continued use of the website or services after an updated version becomes effective constitutes acceptance to the extent permitted by applicable law.
